Felonies are serious criminal charges that could result in a jail term if convicted. Each and every Felony case must be dealt with on personal basis with the attorney who will be protecting your rights and liberties. If you have a felony case, please call the office and schedule an appointment to speak with Mr. Baker about your case one on one. You may have more rights and options available to you than you think you do.

Misdemeanors are less serious criminal matters than felonies, however, being accused of a misdemeanor is enough to ruin your good criminal record for the rest of your life. This is true even if you are found to be innocent. If you have been accused of a misdemeanor, it is almost as important to work to clean your record of the charge as it is to prove yourself to be innocent of the crime. The Baker Law Offices can help you to win your case, and to seal/expunge your record when your case is over.

Seal & Expungements

Felony and Misdemeanor records can be sealed/expunged after a criminal case is closed. Not everyone is eligible to have a criminal case sealed/expunged. There are certain crimes which can never be sealed/expunged. Additionally, there are rules about how many case can be taken off of a criminal record, how long a person has to wait after the case is closed, and the type of plea the person agreed to. If you have a charge on your criminal record that is causing you problems please call The Baker Law Offices to see if there is a chance that you can have this record sealed/expunged. Sealing/expunging a criminal record could change you life.

Bench & Capias Warrants

A bench warrant/capias is generally issued by a judge for failing to appear in court. Driving Under the Influence

Driving under the influence of alcohol or drugs is a very serious offense. The State of Florida has the burden of proving a defendant is guilty beyond and to the exclusion of a reasonable doubt. Beyond and to the exclusion of a reasonable doubt is a very high standard which gives experienced attorneys many different options to protect their client’s rights. Just because someone has been charged with a DUI does not mean that person is automatically guilty. There are many more rights and options available to someone accused of DUI than that person may think.

Criminal Traffic

Criminal traffic tickets, like driving with a suspended license, no valid license, driving with an expired license, reckless driving, and allowing an unauthorized driver to drive, are more serious than non-criminal traffic tickets, and like misdemeanors and felonies, a person who has been accused of one these offenses has to appear in court or hire an attorney to go to court in that person’s place. The Baker Law Offices has worked on tens of thousands of these cases since 1996. There are many technicalities in Criminal Traffic Tickets and The Baker Law Offices know them all. Please do not hesitate call one of our offices to take care of a Criminal Traffic Ticket for you.

Traffic Tickets

The Baker Law Offices fights simple Traffic Tickets at a reasonable cost. Traffic ticket defense is full of technical defenses. Fighting a traffic ticket is generally a two stage defense, there is a pretrial conference which must be attended, and then if the ticket is not resolved at the pretrial conference, there is a trial where the officer who issued the ticket is asked to come to court to testify against the defendant. A traffic ticket should never simply be paid. Paying a traffic ticket adds points to driving records and as a result, increases car insurance. It is a known fact that insurance companies donate laser gun speed detection devices to police forces in order to make everyone’s car insurance more expensive. The Baker Law Offices guarantees that you will not receive any points on your driving record if you have not had more than two moving violations in the last two years, or The Baker Law Offices will refund your attorney fees. Court fees if any are the client’s responsibility.

Red Light Camera Tickets

Red Light Camera Tickets are annoying and here to stay. The procedure for a red light camera ticket is as follows. The city where ticket was issued sends out a letter which allows the owner of the car to settle the ticket at a discounted rate, {currently $158.00} or to take the ticket to trial in front of a non-lawyer magistrate at city hall. If the ticket is not paid at the $158.00 stage another letter is issued to the owner of the car, this time for $277.00 a citation number is issued by the Clerk of Court in the County where the ticket was issued, and the owner of the car now has thirty days to either request a court date at the court house or to pay the ticket at the inflated rate. There are a number of defenses for these tickets, but The Baker Law Offices will only deal with these tickets at the point that the second letter is issued and ticket is issued a ticket number. The first defense is to sign an affidavit stating who it was that was driving your car, including the person’s name, address, date of birth, and license number. The Baker Law Offices does not charge anything extra to assist a client with this affidavit. The second defense, only deals with right turns at red lights. Assuming that there was no sign at the intersection reading “no right on red” an argument can be made that turn was made safely and in many cases the ticket is dismissed. The Baker Law Offices has dealt with thousands of these tickets. Please call to find out what your options are.

Immigration law is the movement of people from one country into another country in order to settle there. Immigration can arise from economic and/or political reasons, natural disasters, and family re-unification.
